These Terms of Use ("Terms") are a legal agreement between you and the provider of Nardo ("we", "us", "our"), identified in full in Section 16, governing your use of the Nardo mobile application and related services (the "App").
By downloading, creating an account in, or using the App, you accept these Terms. If you do not accept them, do not use the App.
The App is not a medical device and does not provide medical advice. Nardo provides general fitness and exercise information for healthy adults. It is not a substitute for professional medical advice, diagnosis, or treatment, and it is not supervised coaching.
You must be at least 18 years old to use the App and capable of entering a binding contract. The App is not intended for minors, and we do not knowingly permit accounts for them.
You can delete your account at any time in the App under Settings → Delete Account, or by writing to us. Deletion is permanent and removes your training history — see the Privacy Policy for exactly what is deleted.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.
What is free and what is paid. Some features require a paid subscription ("Nardo Pro"). Current plans, prices, and billing periods are shown in the App before you purchase, in your local currency.
Free trial. We may offer a free trial. Unless you cancel before the trial ends, the trial converts automatically into a paid subscription and the then-current price is charged. Trial eligibility is determined by Apple or Google and may not be available if you have used a trial before.
Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, until cancelled. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase and at each renewal.
Cancelling. You can cancel at any time in your Apple App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period — you keep access until then. Uninstalling the App does not cancel your subscription, and deleting your Nardo account does not cancel it either. We cannot cancel a store subscription on your behalf.
Price changes. We may change prices. Changes never affect a period you have already paid for, and we (or the app store) will give you notice and the opportunity to cancel before a change takes effect, as required by the app store's rules.
Refunds. Purchases are made through Apple or Google, so refunds are handled under their policies, not by us. Contact Apple Support or Google Play Support for refund requests.
EU/EEA right of withdrawal. If you are a consumer in the EU/EEA, you normally have 14 days to withdraw from a distance contract for digital content. By starting to use a subscription immediately, you request immediate performance and acknowledge that you lose that right of withdrawal once the service has been fully performed. This does not affect your statutory rights where they cannot be waived, and it does not limit any more generous refund policy offered by Apple or Google.
The App uses automated systems, including third-party AI services, to build and adjust training programs. Suggestions are generated from the information you provide and from a curated exercise library. They are general in nature, may contain errors, and are not reviewed by a physician, physiotherapist, or certified trainer before you see them. Proposed changes to your program require your approval before they take effect. You remain responsible for deciding whether any suggestion is appropriate for you.
You agree not to:
You keep ownership of the data you enter (profile details, workout logs, notes). You grant us the limited licence needed to host and process that data in order to operate the App — generate programs, produce reports, and provide support. How we handle personal data, and the legal bases for it, are described in our Privacy Policy, which forms part of these Terms.
The App, its name, logo, design, text, exercise library, illustrations, and demonstration videos are owned by us or licensed to us and are protected by copyright and other laws. Exercise demonstration media is used under licence from its creators. Nothing in these Terms transfers any ownership to you, and you may not extract, redistribute, or republish the exercise library or media.
We aim to keep the App available but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features, or the App as a whole. If we discontinue a paid feature you have already paid for, we will provide a pro-rata refund of the unused paid period where required by law or store policy. The App requires an internet connection and a supported device and operating system version; these requirements may change over time.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the App. On termination your licence ends; sections that by their nature should survive (including Sections 1, 9, 12, and 13) continue to apply.
To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose, achievement of any specific fitness result, or that the App will be error-free.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. Statutory rights of consumers, including under EU and Romanian consumer protection law, are not affected.
Subject to the paragraph above, we are not liable for indirect, incidental, special, or consequential losses, loss of profit, or loss of data, and our total aggregate liability arising out of or relating to the App is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) EUR 50.
These Terms are governed by Romanian law. Disputes fall under the jurisdiction of the competent Romanian courts. If you are a consumer resident in the EU/EEA, you keep the protection of the mandatory consumer law of your country of residence and may bring proceedings in your local courts. EU consumers may also use the European Commission's online dispute resolution platform.
Both platforms. These Terms are between you and us only, not with Apple or Google. Your use of the App must also comply with the terms of the store you downloaded it from. Apple and Google are not responsible for the App or its content, and have no obligation to provide support or maintenance for it.
Apple (iOS). You acknowledge that: these Terms are concluded between you and us only; we, not Apple, are solely responsible for the App and its content; Apple has no warranty obligation with respect to the App, and any failure to conform to an applicable warranty is our responsibility; Apple is not responsible for addressing your claims relating to the App, including product liability, legal or regulatory non-compliance, or consumer protection claims; if a third party claims the App infringes their intellectual property, we, not Apple, are responsible for investigating and resolving that claim; you comply with applicable third-party terms of agreement when using the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms as the App evolves. Material changes will be announced in the App or by email before they take effect. Continuing to use the App after changes take effect means you accept the updated Terms. If you do not accept them, stop using the App and cancel any subscription.
The App is provided by Togan Robert-Cristian, Str. Vânătorilor nr. 18A, Sfântu Gheorghe, Covasna, România.
